Welcome to Gobelives platform! These Terms and Conditions govern your use of our platform, whether you're booking a property as a guest or listing your property as a host. By accessing or using our platform, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms and Conditions, you may not use our platform.

1. Eligibility and Account Registration

1.1. You must be at least 18 years old to create an account, make bookings, or list properties on our platform.

1.2. You agree to provide accurate, current, and complete information during registration and to update your information as necessary.

1.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

1.4. You may not create multiple accounts or allow others to use your account.

1.5. We reserve the right to suspend or terminate accounts that violate these Terms and Conditions.

2. For Guests - Booking Properties

2.1. By making a booking, you agree to pay the total booking amount, which includes the nightly rate, service fees, cleaning fees, and any applicable taxes.

2.2. You must comply with the property's house rules, check-in/check-out times, and maximum occupancy limits.

2.3. You are responsible for leaving the property in the same condition as you found it. Damage to property may result in additional charges.

2.4. You agree to treat the property and the host's neighborhood with respect.

2.5. Cancellations are subject to the property's cancellation policy. Refunds will be processed according to the applicable policy.

2.6. You may not use the property for any illegal activities or purposes not authorized by the host.

2.7. You are responsible for the conduct of any additional guests you bring to the property.

3. For Hosts - Listing Properties

3.1. You must own or have legal authorization to list and rent the property on our platform.

3.2. You are responsible for ensuring your listing complies with all local laws, regulations, and tax requirements.

3.3. You must provide accurate descriptions, photos, amenities, house rules, and pricing for your property.

3.4. You agree to honor confirmed bookings and provide the property as described in your listing.

3.5. You must maintain your property in a safe, clean, and habitable condition.

3.6. You are responsible for any damage or loss to guest property that occurs due to your negligence.

3.7. You may not discriminate against guests based on race, religion, nationality, disability, gender, or sexual orientation.

3.8. Canceling confirmed bookings may result in penalties, reduced search ranking, or account suspension.

4. Payments and Fees

4.1. Guests pay the total booking amount at the time of booking. Payment is processed through secure third-party payment providers.

4.2. Hosts receive payment after the guest checks in, minus our service fee. Payment schedules may vary based on the payout method selected.

4.3. Our platform charges service fees to both guests and hosts. These fees are clearly disclosed during the booking process.

4.4. All prices are listed in the local currency. Currency conversion fees may apply for international transactions.

4.5. Hosts are responsible for collecting and remitting any applicable taxes (occupancy tax, VAT, etc.) as required by local law.

4.6. Refunds are processed according to the property's cancellation policy. Processing time depends on the payment method.

5. Cancellations and Refunds

5.1. Each property listing has a cancellation policy (Flexible, Moderate, Strict, or Super Strict) set by the host.

5.2. Guests must cancel through the platform to be eligible for any refund according to the applicable policy.

5.3. Service fees may be non-refundable depending on the cancellation policy and timing.

5.4. Host cancellations may result in fees, blocked calendar dates, and potential account suspension.

5.5. In cases of extenuating circumstances (natural disasters, serious illness, etc.), special consideration may be given on a case-by-case basis.

5.6. We reserve the right to cancel bookings and issue full refunds if a listing is found to be fraudulent or significantly misrepresented.

6. Reviews and Ratings

6.1. Both guests and hosts can leave reviews after a stay. Reviews must be submitted within 14 days of check-out.

6.2. Reviews should be honest, accurate, and respectful. We prohibit fake reviews, review manipulation, or reviews containing hate speech.

6.3. Reviews are public and cannot be deleted by users, but may be removed if they violate our content policy.

6.4. Both parties can respond to reviews. Review disputes can be reported to our support team for investigation.

7. Prohibited Activities

7.1. You may not use our platform for any illegal activities, including but not limited to unauthorized parties, drug use, or prostitution.

7.2. Hosts may not list properties they do not own or have authorization to rent.

7.3. Guests may not sublet or assign their booking to another person without host approval.

7.4. You may not circumvent our platform to avoid service fees by arranging direct bookings or payments.

7.5. You may not create fake accounts, manipulate reviews, or engage in fraudulent activities.

7.6. You may not scrape, copy, or misuse content from our platform without permission.

8. Liability and Insurance

8.1. Our platform acts as a marketplace connecting guests and hosts. We are not a party to the rental agreement between you.

8.2. Hosts are responsible for maintaining appropriate insurance coverage for their properties.

8.3. We offer Host Damage Protection (optional) that may cover certain property damage caused by guests.

8.4. Guests are encouraged to obtain travel insurance to cover trip cancellations, medical emergencies, and personal property loss.

8.5. We are not liable for any property damage, personal injury, theft, or other losses that occur during a stay.

8.6. Any disputes between guests and hosts should be resolved directly or through our resolution center.

9. Intellectual Property

9.1. Our platform and its original content, features, design, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.

9.2. You may not copy, modify, distribute, sell, or reproduce any part of our platform without written permission.

9.3. User-generated content (property photos, descriptions, reviews) remains the property of the user who created it.

9.4. By posting content on our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content on our platform and marketing materials.

9.5. You must not post content that infringes on the intellectual property rights of others.

10. Limitation of Liability

10.1. To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

10.2. We are not liable for any losses resulting from: (a) your use or inability to use our platform; (b) any conduct of other users; (c) unauthorized access to your account; (d) property damage or personal injury during a stay; (e) cancellations or booking disputes.

10.3. Our total liability to you for any claims arising from your use of the platform shall not exceed the total fees you paid to us in the 12 months before the claim.

10.4. Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

11. Dispute Resolution

11.1. If you have a dispute with another user (guest or host), we encourage you to contact them directly first to resolve the issue.

11.2. Our Resolution Center is available to help mediate disputes between guests and hosts regarding property damage, refunds, or other booking issues.

11.3. Any disputes with our platform should be directed to our customer support team first.

11.4. If we cannot resolve a dispute through customer support, you agree to resolve disputes through binding arbitration rather than in court, except where prohibited by law.

11.5. Class action lawsuits and class-wide arbitration are not permitted.

12. Governing Law

12.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2. You agree to submit to the exclusive jurisdiction of the courts located in [Your City, State] for resolution of any disputes.

13. Changes to These Terms and Conditions

13.1. We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Terms and Conditions on our platform.

14.4. Provisions that by their nature should survive termination (payment obligations, liability limitations, dispute resolution) will continue to apply.
